These Terms of Service (“Terms”) govern the purchase and use of digital invitation and related services provided by Mahayag Digital Invites, operated by Mahayag Printing, with business address at Purok 4, Doña Andrea, Asuncion, Davao del Norte, Philippines (“Mahayag,” “we,” “us,” or “our”).

By booking a consultation, submitting an order or Client Details Form, electronically accepting these Terms, or making payment for a service, you (“Client,” “you,” or “your”) agree to these Terms.

Nothing in these Terms is intended to exclude or limit any right or remedy that cannot lawfully be waived under Philippine law.

1. Our Services

Mahayag Digital Invites creates customized digital invitation websites for weddings, debuts, birthdays, christenings or baptisms, anniversaries, and other celebrations.

Our available packages, inclusions, revision limits, hosting periods, add-ons, prices, and promotional rates are those displayed or expressly quoted to you at the time you place your order.

We may change our future prices, packages, or inclusions at any time. Changes will not retroactively alter an order that has already been paid and confirmed unless both parties agree in writing.

Where there is a conflict between a package description on our website and a specific written quotation issued to you, the written quotation accepted by both parties will govern that order.

2. Ordering Process

Our usual process is:

Consultation or inquiry. You may contact us or book a free consultation to discuss your event and requirements.

Package selection. You select a package or approve a custom quotation.

Payment. Payment is made through our accepted payment methods.

Client Details Form. You provide the information, images, event details, and other materials required for production.

Design and preview. We prepare your invitation and provide a preview.

Revisions. You may request revisions within the allowance included in your selected package.

Approval. You review the final version and provide written or electronic approval.

Publishing. We publish the invitation and provide the applicable live link, RSVP access, or related deliverables.

Production will normally begin only after the required payment and complete information have been received.

3. Prices and Payment

All prices are stated in Philippine Pesos (₱) unless otherwise indicated.

Full payment is generally required before production begins unless we expressly agree to another arrangement in writing.

Accepted payment methods may include GCash, Maya, bank transfer, or other methods communicated to you at the time of purchase.

Additional features, add-ons, major design changes, rush work, additional revision rounds, printing, or requests outside the selected package may require additional payment. We will inform you of the additional price and obtain your approval before performing chargeable extra work.

Where required by law, we will provide the appropriate invoice, receipt, or transaction record for payments received.

4. Client Information and Responsibilities

You are responsible for providing accurate and complete information for your invitation.

This includes names, dates, times, venue details, links, schedules, entourage information, RSVP instructions, photographs, and other event information.

We are not responsible for errors that result directly from inaccurate or incomplete information supplied by you, provided that we reproduced the information you supplied accurately.

You must review the preview carefully before final approval.

You also represent that you have the necessary rights, authority, consent, or permission to provide and use any photographs, music, videos, logos, names, artwork, or other content that you submit to us.

If a third party makes a legitimate claim regarding material supplied by you, you agree to cooperate reasonably in resolving the issue.

5. Turnaround Time

Our standard production estimate is generally 2–5 business days after we receive both:

the required payment; and

a complete Client Details Form and all required content.

Turnaround time is an estimate and may vary depending on project complexity, revision requests, incomplete submissions, client response time, technical issues, peak periods, or custom requirements.

If important information is missing, the production period may be paused until the required information is received.

We will make reasonable efforts to notify you of material delays.

6. Revisions

Each package includes the number of revision rounds stated in the package description or quotation accepted at the time of purchase.

A revision round means one consolidated set of requested changes submitted at one time.

Requests submitted separately may be treated as separate revision rounds.

Revisions must remain reasonably within the scope of the original package and agreed design direction. A substantial redesign, new concept, or major change in event requirements may be treated as additional work and may require an additional fee.

Before charging for additional revisions, we will advise you of the applicable cost.

7. Final Approval

You are responsible for reviewing the final preview before publishing.

Your written approval through Messenger, email, form submission, or another recorded electronic communication will be treated as authorization to publish the approved version.

After final approval, corrections or changes may still be requested subject to:

your remaining revision allowance;

the scope of the requested change; and

any applicable additional fee.

8. Hosting and Validity Period

Your digital invitation remains active for the hosting or validity period included in your package.

The applicable period will be disclosed in the package details or quotation before purchase.

After the included hosting period ends, the invitation may be disabled or removed unless you purchase an extension or renewal.

Renewal availability and pricing may vary at the time renewal is requested.

We do not guarantee indefinite storage of expired invitation websites, RSVP information, uploaded files, or project data.

Data retention and deletion are also subject to our Privacy Policy and applicable Philippine data privacy requirements.

9. Cancellations and Refunds

Because our service involves customized design work, refund eligibility depends on the stage of the project.

Before production begins: If you cancel before we begin customized design or production work, you may request cancellation and a refund of amounts paid, less any lawful and clearly disclosed non-refundable third-party costs already incurred specifically for your order, if any.

After customized work has begun: If you cancel after we have commenced customized work, any refund may be reduced to reflect work already reasonably performed and non-recoverable project-specific costs.

However, this cancellation policy does not remove or restrict any remedy you may have under applicable Philippine consumer law where services are defective, materially non-conforming, not performed with due care and skill, or otherwise give rise to a statutory right to repair, correction, refund, or other remedy.

Refund requests must be submitted through our official contact channels and should include the name used for the order, the transaction details, and the reason for the request.

10. Intellectual Property

Unless otherwise agreed in writing, Mahayag retains ownership of its reusable templates, code, layouts, systems, design methods, graphics, website structure, and other pre-existing or reusable materials.

Your payment gives you the right to use the customized invitation produced for your event for its intended personal use during the applicable service period.

You retain ownership of original photographs, videos, text, and other materials that you lawfully provide to us.

You grant us the limited permission necessary to process, reproduce, resize, host, and display those materials solely for providing the ordered service.

Nothing in your purchase gives you ownership of Mahayag’s underlying reusable software, templates, design systems, or proprietary production methods unless expressly stated in writing.

11. Portfolio and Marketing Use

We will not automatically assume permission to use identifiable client photographs, names, or private event information for advertising merely because you purchased our service.

If we wish to feature an identifiable completed project in our portfolio, website, or social media, we may request your permission.

We may display samples that have been sufficiently anonymized or use materials for which we have obtained the necessary permission.

This is safer than relying on a broad opt-out clause because personal information and identifiable photographs are subject to Philippine data privacy requirements. 12. Privacy and Personal Data

We collect and process personal information only for legitimate purposes related to inquiries, order fulfillment, digital invitation production, hosting, RSVP functionality, customer support, accounting, legal compliance, and other purposes described in our Privacy Policy.

Personal information may include information submitted by the Client and, where applicable, information submitted by guests through RSVP forms.

Our handling of personal information is subject to the Data Privacy Act of 2012 (Republic Act No. 10173) and applicable issuances of the National Privacy Commission.

Please read our separate Privacy Policy / Privacy Notice for information regarding:

what personal information we collect;

why we collect it;

who may receive or process it;

how long it may be retained;

the rights of data subjects; and

how privacy concerns may be raised.

The Data Privacy Act requires personal information to be collected for specified legitimate purposes, processed fairly and lawfully, kept only as long as necessary, and appropriately protected. Privacy Commission

13. RSVP Information

Where your package includes RSVP functionality, the Client is responsible for determining the guests to whom the invitation link is shared.

RSVP information is intended to assist with event planning, but it should not be treated as a guaranteed final attendance count.

We will take reasonable measures to maintain the functionality of the RSVP system, but responses may be affected by guest error, connectivity, browser issues, third-party services, duplicate submissions, or other factors outside our reasonable control.

14. Third-Party Services and Availability

Our services may depend on third-party platforms or infrastructure such as hosting providers, domain services, internet providers, payment services, maps, media services, messaging platforms, or other technology providers.

We will use reasonable care in providing the service, but we cannot guarantee uninterrupted availability of third-party systems that are outside our reasonable control.

If a material technical issue affecting our service occurs, we will make reasonable efforts to restore or provide an appropriate workaround.

15. Limitation of Liability

To the fullest extent permitted by Philippine law, Mahayag will not be responsible for losses caused solely by circumstances beyond our reasonable control or by inaccurate information, unauthorized sharing, misuse, or materials supplied by the Client.

Nothing in these Terms excludes or limits liability or consumer remedies that cannot legally be excluded or limited under Philippine law.

Any contractual limitation of liability will apply only to the extent permitted by law and will not operate to excuse fraud, willful misconduct, gross negligence, or obligations that applicable law makes non-waivable.

I would not keep the old absolute sentence saying total liability is always limited to the package price without qualification. It is safer to make any limitation expressly subject to applicable law.

16. Force Majeure

We will not be considered in breach for delays caused by events genuinely beyond our reasonable control, including severe weather, natural disasters, widespread power or telecommunications failures, government actions, major service-provider outages, or similar events.

We will make reasonable efforts to notify affected clients and resume service as soon as reasonably practicable.

17. Online Transactions and Consumer Rights

Mahayag conducts transactions through online channels and is therefore subject to applicable Philippine rules governing electronic commerce and internet transactions.

Our website and online transaction process should clearly provide accurate information concerning our identity, contact information, business location, services, pricing, payment terms, and cancellation/refund policies. Nothing in these Terms waives the Client’s right to seek assistance or file an appropriate complaint with the Department of Trade and Industry or another government authority where applicable.

18. Complaints and Resolution

If you have a complaint regarding your order, please contact us first so that we may attempt to resolve the matter promptly.

We may request supporting information such as screenshots, transaction records, order details, or correspondence reasonably necessary to evaluate the concern.

If a consumer dispute cannot be resolved directly, the Client may use remedies available under Philippine law, including applicable DTI mediation or adjudication procedures. 19. Changes to These Terms

We may revise these Terms for future transactions.

The version that applies to your order is generally the version presented or available when your order and payment were accepted, unless a later change is required by law or is expressly agreed by both parties.

We will not retroactively impose a materially less favorable contractual term on an already confirmed order merely by updating the website.

20. Governing Law and Disputes

These Terms are governed by the laws of the Republic of the Philippines.

The parties are encouraged to first attempt good-faith resolution of disputes.

Nothing in these Terms prevents a consumer from pursuing any complaint, administrative remedy, mediation, or other remedy available through the Department of Trade and Industry, National Privacy Commission, or other competent government authority.

Any court action will be filed before a court having proper jurisdiction and venue under applicable Philippine law and procedural rules.

I would use this instead of saying every dispute “shall be subject to the courts of Davao del Norte,” because you should not word the clause in a way that could appear to remove a consumer’s statutory or administrative remedies.
